A judge has squashed CTV’s mandatory retirement policy, citing it to be unconstitutional.

Court of Queen’s Bench Justice Albert Clearwater ruled Wednesday that Terry Kenny, a technician at CTV Winnipeg and CKY for nearly 30 years, was wrongfully forced to retire on his 65th birthday.

Kenny filed a grievance in 2006, and challenged the decision with the support of his union, Local 816M of the Communication, Energy and Paperworkers Union.

Back when the story first made headlines a few years ago, the public had Kenny’s back on the issue, bringing up longtime CTV News anchor Lloyd Robertson as an example of an employee older than 65.

In a related note, Sylvia Kuzyk won’t be going anywhere soon.
